CFPB's "2013 HOEPA Rule"

Section 32, Points and Fees Threshold: The Section 32, Points and Fees Threshold has been lowered to 5% of Loan Amount (Principal dwelling only)

Section 32, APR Thresholds: The APR Thresholds have been lowered to:

Greater than 6.5% above APOR for comparable transactions for the first lien loans;

Greater than 8.5% if dwelling is personal property and the loan amount is less than $50,000

 

Credit life or similar insurance payable at or before closing if the lender is the beneficiary.

Special Rule for HELOC’s: To calculate “points and fees” for HELOCS under Regulation Z,participation fees payable at or before account opening, if any and

   fees charged to consumers to draw on their credit line at least once, must be included.

There are three main prohibitions in the LO Comp Rule:

Loan originators cannot receive compensation that is based on the terms or conditions of the loan, other than loan amount.

Loan originators cannot receive compensation from both a consumer and any other source, which includes the lender.

Loan originators may not direct (or “steer”) a consumer to accept a loan that is not in the consumer’s interest in order to

    increase the loan originator’s compensation.
